1. Acceptance of Terms

By accessing or using HSCoopHQ ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. These Terms apply to all users of the Service, including co-op administrators, teachers, and family members.

2. Description of Service

HSCoopHQ provides a web-based platform for homeschool co-op management, including but not limited to:

  • Class scheduling and registration
  • Attendance tracking via QR codes
  • Payment processing and financial management
  • Communication tools for co-op members
  • Waitlist management
  • Administrative dashboards and reporting

3. User Accounts

3.1 Account Creation

To use the Service, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.2 Account Types

The Service offers different account types with varying permissions:

  • Co-op Administrators: Full access to manage the co-op, including settings, users, classes, and finances.
  • Teachers: Access to manage assigned classes and take attendance.
  • Family Members: Access to view schedules, make payments, and manage their family's registrations.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Share your account credentials with others
  • Attempt to gain unauthorized access to any part of the Service
  • Upload malicious code or interfere with the Service's operation
  • Use the Service to send spam or unsolicited communications
  • Collect or harvest user data without consent
  • Impersonate another person or entity

5. Payment Terms

5.1 Subscription Fees

HSCoopHQ offers subscription plans based on co-op size. Fees are billed annually in advance. Current pricing is available on our pricing page.

5.2 Payment Processing

We use third-party payment processors (such as Stripe) to handle transactions. By using our payment features, you also agree to the payment processor's terms of service.

5.3 Refunds

Subscription fees are non-refundable except as required by law. If you cancel your subscription, you will retain access until the end of your current billing period.

6. Data and Privacy

6.1 Your Data

You retain ownership of all data you input into the Service. We do not sell your data to third parties. See our Privacy Policy for details on how we collect, use, and protect your information.

6.2 Data Export

You may export your data at any time through the Service's export features. Upon account termination, we will provide a reasonable period to export your data before deletion.

6.3 Children's Privacy

The Service may contain information about minor children as part of homeschool co-op management. Co-op administrators are responsible for obtaining appropriate parental consent for any data collected about minors. We comply with COPPA and other applicable regulations regarding children's privacy.

7. Intellectual Property

The Service, including its design, features, and content (excluding user data), is owned by HSCoopHQ and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

HSCoopHQ is a management tool and does not provide educational, legal, or financial advice. Users are responsible for ensuring their co-op complies with applicable homeschool laws and regulations.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HSCOOPHQ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless HSCoopHQ and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

11. Termination

Either party may terminate the agreement at any time. We may suspend or terminate your access to the Service immediately if you violate these Terms. Upon termination, your right to use the Service ceases, though certain provisions of these Terms will survive termination.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware.
